Recognition of foreign certificates of conformity,
marks of conformity, test reports and other conformity assessment documents
1. AT THE LEVEL OF THE REPUBLIC OF KAZAKHSTAN
1. General information
Foreign certificates of conformity are recognized in
accordance with concluded agreements (treaties).
Foreign certificates of conformity issued for products
that are subject to mandatory conformity assessment are recognized by reissuing
them as certificates of conformity in the forms stipulated in the State System
of Technical Regulation of the Republic
of Kazakhstan.
Foreign certificates of conformity, test reports,
marks of conformity and other documents issued in foreign conformity assessment
systems are recognized subject to the presence of the respective international
agreements (treaties) recognizing the results of conformity assessments.
In the absence of international treaties, the
conformity of imported products to the requirements established for them are
assessed according to general regulations and provisions established in the
State System of Technical Regulation.
Foreign documents and marks of relating to conformity
assessment for imported products are recognized on the basis of the importer’s
(applicant’s) application on the form of Appendix 1on a contractual basis by
conformity assessment agencies accredited in the State System of Technical
Regulation of the Republic of Kazakhstan and having the declared kind of
products (goods) in their area of accreditation.
The process of recognizing documents and marks issued
in foreign conformity assessment systems for imported products subject to
mandatory assessment and intended for sale is carried out provided that they
are accompanied by information in the official or Russian languages.
The information must include the name of the products,
country and manufacturer (performer), shelf life (best before date, service
life), storage conditions, method of use (if the presence of said information
is governed by technical regulatory acts.
The applicant is responsible for the authenticity of
the translation.
2. Work procedure
1) an application is submitted
for recognition of a certificate of conformity for a production lot with
attached set of shipping documents
2) a decision is made after
examining the application
3) a Applicant and the
certification agency execute a contract
4) a decision is made on
recognizing the foreign certificate
5) a certificate of conformity
from CIS countries is reissued as a certificate of conformity of the State
System of Technical Regulation of the Republic of Kazakhstan,
entered in the Register of the SSTR and issued to the Applicant
The following procedures are performed in making a
decision on recognizing a foreign certificate or copy thereof:
expert evaluation of the
documents attached to the application
identification of the products
(goods) for which the certificate of conformity was issued
checking for the availability
of consumer information
The authenticity and consistency of the documents are
verified during the expert evaluation.
3. Accompanying documents
The importer (applicant) attaches the following
documents for recognition of a foreign certificate of conformity:
1) the original of the foreign
certificate of conformity or a copy thereof certified by the signature and
stamp of the conformity assessment agency that issued the certificate of
conformity or the enterprise (firm) holding the original of the certificate, or
notarized according to the established procedure;
2) the regulatory document
specified in the foreign certificate of conformity, unless it is an
international document valid in the Republic
of Kazakhstan;
3) documents accompanying the
products: copy of the customs declaration, certificate of origin of the
products (goods), contract, waybill, invoice, product test report, hygienic
opinion, veterinary opinion, phytosanitary certificate, quality management
system certificate and other documents in accordance with current legislation
of the Russian Federation (e.g., a letter from the State Standards Committee
authorizing the issue of a certificate outside the accreditation scope of the
conformity assessment agency, if there are no laboratories for this purpose in
the Republic of Kazakhstan).
Failure to provide any of the listed documents does
not constitute grounds for refusing to issue a certificate of conformity, but
does serve as a basis for performing the required product tests (analysis) with
respect to the indicators not confirmed in the documents presented by the
applicant.
Documents attached to the application must be in the
official or Russian languages. If they are drawn up in other languages, an
authentic translation must be attached to the documents. The applicant is
responsible for the authenticity of the translation.
