When an individual production lot subject to mandatory
conformity assessment (certification) is imported across the customs border of
the Republic of Kazakhstan, a statement of declaration
is stipulated for customs clearance of the cargo, followed by presentation of
the products for identification and sampling for certification tests
A statement of declaration is a document with which
the importer declares at its own risk that the products it is importing into
the Republic of Kazakhstan conform to all requirements
for ensuring the safety of the life and health of people and personal property
and environmental protection stipulated for these products, and the
requirements of technical regulatory documents
The statement of declaration is drawn up and
registered by a conformity assessment agency having the declared kind of
products in its area of accreditation after concluding a conformity assessment
contract with the importer
A statement of declaration duly drawn up and
registered is valid only for customs clearance of the products being imported
Products that have passed customs clearance under a
statement of declaration are subject to further conformity assessment at the
conformity assessment agency that registered the statement of declaration
A statement of declaration is drawn up for a specific
kind of product subject to mandatory conformity assessment according to the code of the Commodity
Classifier for Foreign Economic Activities CC FEA)
Drawing up, registering and issuing statements of
declaration are governed by:
Regulations on registering statements of declaration
approved by Order No. 429 of the Minister of Industry and Trade of October 29,
2008
Regulations on keeping electronic records of data on registered
declarations of conformity, statements of declaration, certificates of
conformity issued, avoidance of a conformity assessment by applicants who have registered statements of
declaration and denials
of certification approved by order No. 428 of the Minister of Industry
and Trade of October 29, 2008
A statement of
declaration is drawn up and registered on the following basis:
1) documents
defining the applicant’s legal status
for
individuals — identification document or passport, certificate of state
registration as an individual entrepreneur, taxpayer’s certificate
for legal entities —
certificate of state registration of a legal entity, articles of association,
statistics card, taxpayer’s certificate, certificate of value added tax registration
(if available)
2) shipping documents (bill,
invoice, waybill)
3) documents verifying origin of
goods
4) documents verifying product
safety
5) regulatory
documents for the products
